Terms of Use (EULA)

Effective Date: 2026-05-19  ·  App: Diffr (iOS) — published by Truake

By using Diffr, you agree to these terms. They're written in plain English. If something's unclear, email diffr@truake.com.

1. The basics

2. Your account

3. Content you create

You own what you post (tier lists, comments, ratings, custom labels). By posting publicly, you grant Diffr a non-exclusive, royalty-free license to display it within the app and at related URLs (diffr.truake.com/tier/<uuid>), and to feature popular tier lists in promotional materials (with attribution if requested).

You agree not to post:

There is zero tolerance for objectionable content or abusive users. Comments and tier list notes should be honest opinions. Diffr is a discussion platform; we encourage strong opinions, but personal attacks on brand employees, founders, or other users will be removed. You can report objectionable content or block an abusive user from anywhere it appears in the app; we review reports and remove violating content (and may eject the user) within 24 hours.

4. Brand content & fair use

Diffr displays brand logos, names, and basic information for the purpose of comparison, discovery, and discussion. This is consistent with U.S. trademark fair use (nominative fair use doctrine, see New Kids on the Block v. News America Publishing, 9th Cir. 1992).

Brand owners who want their information removed can:

We respond within 14 days. We will not remove content based solely on negative user ratings — those are protected opinion.

5. Prohibited conduct

You may not:

Severe violations (CSAM, threats of violence, large-scale spam) = immediate permanent ban without warning.

6. The Crown Rating qualification

To rate brands with Crowns, you must complete: (a) the onboarding tutorial, and (b) use the List & Buy flow at least once. This is a quality gate — we don't want random throwaway accounts skewing brand ratings.

If you bypass this gate by means we'd consider deceptive (creating multiple accounts to mass-rate, etc.), we may invalidate your ratings and warn or suspend the account.

7. Pro Subscription

8. Affiliate links

Diffr earns affiliate commission when you click product links and complete purchases on partner retailers (Amazon, Best Buy, etc.). This is disclosed in-app. Commission doesn't influence rankings: brand scores are independent of any affiliate relationship.

9. Disclaimers

10. Limitation of liability

To the maximum extent permitted by law, Diffr / Truake / Rock Lam are not liable for:

This doesn't apply to claims that can't be limited by law (e.g., gross negligence in some jurisdictions).

11. Indemnification

You agree to defend and hold harmless Diffr / Truake from claims arising from your content or your violations of these terms.

12. Governing law

These terms are governed by the laws of the State of California, USA. Disputes shall be resolved in the state or federal courts located in California.

If you're a consumer in the EU / UK / Australia, local consumer protection laws still apply regardless.

13. Termination

We can terminate or suspend access for terms violations. You can stop using Diffr at any time. Sections on Content ownership, Limitation of liability, and Indemnification survive termination.
